In this brief, we argue that there is a diversity of ways in which humans (Homo sapiens) are ‘persons’ and there are no non-arbitrary conceptions of ‘personhood’ that can include all humans and exclude all nonhuman animals. To do so we describe and assess the four most prominent conceptions of ‘personhood’ that can be found in the rulings concerning Kiko and Tommy, with particular focus on the most recent decision, Nonhuman Rights Project, Inc v Lavery.

The lead-off essay by Kenneth Minogue is an Oakeshottian reflection on the extent to which modern people have become passive spectators of action, detached from traditional loyalties and modes of identity and thus a kind of new Epicurean, shorn of the genuinely contemplative character of the originals. Eric Ormsby follows this with a judicious appraisal of the possibilities and perils for culture associated with the advent of the new information technology. Anthony Daniels provides a similarly sober account of the many (...) consequences and dilemmas of medical technology for the noble Hippocratic art. David Pryce-Jones’s essay recounts the antipolitical utopianism of the totalitarian ideologies that shadowed most of the twentieth century and worries about the potentially destructive utopian tendencies in the contemporary project of European integration. Keith Windschuttle surveys the range of ideologies currently deployed in the academy, most of which derive from vulgarizations of Nietzsche. Edward Said’s influential body of work comes in for particular scrutiny here. Mark Steyn contributes a discussion of the now all-too-familiar self-hatred of Western intellectuals with the blunt precision and wit so characteristic of his splendid newspaper columns. Martin Greenberg’s essay on Burke manages to educe in brief compass the understanding of freedom that is the animating heart of that exemplary statesman’s thought and practice. Diana Schaub makes a case for the importance of political philosophy to the practice of modern politics centered on the statesmanship of Lincoln. Robert Bork’s chapter on the “adversary judiciary” limns the extent to which judges have gone from being the guarantors of the rule of law to the most effective antagonists of traditional institutions and values. Finally, Roger Kimball fittingly recalls the original Ciceronian understanding of culture as the development of the mind analogous to the cultivation of the earth, and connects it with the celebrated program of criticism proposed by Matthew Arnold. Recent work in the Philosophy of Mind has suggested that alternatives to reduction are required in order to explain the relationship between psychology and biology or physics. Emergence has been proposed as one such alternative. In this paper, I propose a precise definition of emergence, and I argue that chaotic systems provide concrete examples of properties that meet this definition. In particular, I suggest that being in the basin of attraction of a strange attractor is an emergent property of any (...) chaotic nonlinear dynamical system. This shows that non-reductive accounts of inter-theoretic relations are necessary, and that non-reductive accounts of the mental are possible. Moreover, this work provides a foundation for future work investigating the nature of explanation, prediction, and scientific understanding of non-reductive phenomena. (shrink)

Here, we argue that the two most common contemporary critiques of luck egalitarianism, holding it to be harsh and disrespectful are best understood as illustrating exactly this tension. Presented here is an overview from the standpoints of sociology, history of science, philosophy of science and “pure science” of the lingering question of whether sociology is a form of scientific pursuit. The conclusion is drawn that sociology barely meets any of the rigid criteria traditionally associated with the natural sciences. Sociology is viewed as having a position of theory and argument which is labeled “inconoclastic scepticism.”.

This dissertation investigates the complex phenomenon of familial intimacy as a distinctive and essential basis of self-identity and ethical obligation. The account of the family is developed in accordance with the social categories that Hegel articulates in the context of his two most developed studies of human institutions, the Philosophy of Right and the Phenomenology of Spirit, to demonstrate that Hegel's systematic approach to social and political issues provides us with indispensable insights into the inescapably intersubjective nature of all dimensions (...) of human experience and action. Familial sociality is shown to be distinguished from other forms of intersubjective relation by the fact that it has its basis in a primarily unconscious and affective experience of intimacy---an experience that implicates a person's identity and a person's actions in the identities and actions of others in ways that ultimately resist rational reflection and autonomous self-articulation. This analysis of the inner workings of familial self-identification is used as a lens through which to gain new perspectives on the manner in which social forces shape the very texture of human perceptual life. The unconscious nature of family intimacy is shown to complicate our understanding of collective responsibility for, and complicity in, social acts. This analysis also affords us with insights into the essentially communal basis of property holding, for, it is argued, within the familial sphere, property is best understood as the expression of an intimacy and ongoing communication with other selves, rather than as something that fences one off from others. A reissue of a classic text, Norms and Nobility is a provocative reappraisal of classical education that offers a workable program for contemporary school reform. David Hicks contends that the classical tradition promotes a spirit of inquiry that is concerned with the development of style and conscience, which makes it an effective and meaningful form of education. The classical utilitarian legacy of Jeremy Bentham, J. S. Mill, James Mill, and Henry Sidgwick has often been charged with both theoretical and practical complicity in the growth of British imperialism and the emerging racialist discourse of the nineteenth century. But there has been little scholarly work devoted to bringing together the conflicting interpretive perspectives on this legacy and its complex evolution with respect to orientalism and imperialism. This volume, with contributions by leading scholars in the field, represents the first (...) attempt to survey the full range of current scholarly controversy on how the classical utilitarians conceived of 'race' and the part it played in their ethical and political programs, particularly with respect to such issues as slavery and the governance of India. Objectives To investigate risk perception relating to living kidney donation, to compare the risk donors would accept with current practice and identify influential factors. Design An observational study consisting of questionnaires completed by previous living donors and the general public. Participants selected the risk they would accept from a list of options, in various scenarios. Risk communication was investigated by randomly dividing the sample and presenting risk differently. Setting Primary care (two centres) and secondary care (one centre), London. Participants 175 (...) questionnaires were sent to patients who had previously undergone living-donor nephrectomy and to members of the public consulting a general practitioner. The living-donor sample comprised 77 consecutive donors at Guy's Hospital from May 2003 to January 2005. The general-public sample was recruited from two London healthcare centres. Of the eventual 151 participants, 61 were living donors and 90 were from the general public. Main outcome measure The amount of risk a participant would accept to donate a kidney. Results 74% of participants were willing to accept a risk of death higher than 1/3000. The most commonly accepted risk was 1/2 (29%). Those presented with a ‘chance of survival’ accepted higher risks than those presented with a ‘risk of death’ (p<0.01). Greater risks were accepted when the recipient was closely related and, for some, when the recipient's prognosis was worse. No difference was observed between the living-donor and general-public groups. Conclusions Kidney donors will accept a higher risk of death than is currently quoted, especially if risks are presented in terms of chance of survival. (shrink)

I will argue that this class of heretoforeunknown ethical problems arise in broadcastcommunication received with a device of some kind, andinvolve what I will call impersonal interaction. Ialso argue that the moral element in such problemslies in a conflict between property rights and freespeech rights. Finally, I will argue that the bestapproach to solving these problems requires thecreation of a new standard protocol for computercommunication rather than laws (...) governing the use ofcomputers. While the obligation of confidentiality is integral to professional ethical codes and is also safeguarded under English law through the equitable remedy of breach of confidence, underpinned by the right to privacy enshrined in Article 8 of the Human Rights Act 1998, it has never been regarded as absolute. But when can and should personal information be made available for statistical and research purposes and (...) what if the information in question is highly sensitive information, such as that relating to the termination of pregnancy after 24 weeks? This article explores the case of In the Matter of an Appeal to the Information Tribunal under section 57 of the Freedom of Information Act 2000, concerning the decision of the Department of Health to withhold some statistical data from the publication of its annual abortion statistics. The specific data being withheld concerned the termination for serious fetal handicap under section 1(1)d of the Abortion Act 1967. The paper explores the implications of this case, which relate both to the nature and scope of personal privacy. It suggests that lessons can be drawn from this case about public interest and use of statistical information and also about general policy issues concerning the legal regulation of confidentiality and privacy in the future.
